Case summary

Ishmel Simmons (1910-1951), a farm worker, was killed by Newton Hanes in Brice Creek, Craven County, North Carolina. According to the Civil Rights Congress, Simmons was a tenant farmer on Hanes’ land, and when he went to collect $30 that was owed him, Hanes fatally shot him. Hanes was tried for second-degree murder, and claimed self-defense. Trial jury acquitted. Hanes paid Simmons’ wife Martha Simmons $5,100 to, according to Jet magazine, “forestall a possible civil suit.”
